TERMS AND CONDITIONS FOR PLATFORM USERS & CUSTOMERS
1. INTRODUCTION & SCOPE
1.1. These Terms and Conditions (“Terms”) govern the access to and use of this e-commerce portal and mobile applications (“Platform”).
1.2. By accessing, browsing, or booking any service through the Platform, you (“Customer,” “User,” or “You”) agree to be bound by these Terms and the laws of the United Arab Emirates (“UAE”).
2. NATURE OF THE PLATFORM & DIRECT VENDOR CONTRACTING
2.1. The Platform operates strictly as an intermediary lead-generation and booking distribution portal connecting Customers with independent third-party service providers (“Vendors”).
2.2. Vendors pay a monthly subscription fee to list their services on the Platform, and the Platform earns a commission fee per booking forwarded to the Vendor.
2.3. The Platform does not deliver, perform, control, or employ personnel for any services listed. The direct legal contract for service performance is strictly between the Customer and the Vendor.
3. BOOKINGS AND DIRECT PAYMENT TERMS
3.1. No Payment Processing by Platform: The Platform acts solely to transmit and forward booking requests to Vendors. The Platform does not process, collect, hold, or accept any payments on behalf of Vendors or Customers.
3.2. Direct Payment to Vendor: All financial transactions, service fees, and payments must be settled directly between the Customer and the Vendor using the payment methods agreed upon between those two parties (e.g., cash, direct card transaction to Vendor, or direct transfer).
3.3. All prices listed on the Platform are provided by Vendors in United Arab Emirates Dirhams (AED) and are inclusive of applicable UAE Value Added Tax (VAT) unless explicitly stated otherwise. The Customer acknowledges that final billing and tax invoicing are the sole responsibility of the performing Vendor.
4. CANCELLATIONS, CHANGES, AND REFUNDS
4.1. Because the Platform collects no payment, all cancellation terms, rescheduling requests, fee adjustments, and refund claims are strictly subject to the individual Vendor’s cancellation policy and must be managed directly between the Customer and the Vendor.
4.2. The Platform shall not be liable for any financial disputes, uncollected payments, or refund claims arising between Customers and Vendors.
5. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES
5.1. No Responsibility for Vendor Services: To the maximum extent permitted under UAE Federal Law No. 15 of 2020 on Consumer Protection and UAE Civil Transactions Law, the Platform explicitly disclaims all liability for the quality, safety, legality, timeliness, fulfillment, or non-performance of services provided by Vendors.
5.2. The Customer acknowledges that Vendors operate as independent third-party contractors. The Platform does not guarantee, warrant, or insure any work quality, property damage, personal injury, late arrivals, or unsatisfactory outcomes resulting from a Vendor’s service.
5.3. In no event shall the Platform’s total liability exceed the referral commission earned by the Platform for the specific booking in dispute.
6. CUSTOMER DISPUTES AND PLATFORM MEDIATION ROLE
6.1. If a dispute arises regarding a forwarded booking or service outcome, the Customer agrees to raise the issue directly with the Vendor or via the Platform’s support channel within 24 hours.
6.2. Platform Role as Informal Arbitrator/Mediator: The Platform acts solely as an informal mediator to facilitate communication and assist both parties in reaching an amicable resolution. The Platform’s administrative determination during informal mediation is limited to internal actions (e.g., listing status review, warning issuance, or Vendor subscription suspension).
7. USER OBLIGATIONS AND ACCEPTABLE USE
7.1. Customers agree to provide accurate booking information, ensure safe access to premises (where applicable), and treat Vendor personnel with respect.
7.2. Any fraudulent booking requests, spamming, or abuse of the Platform will result in immediate account termination.
8. GOVERNING LAW AND JURISDICTION
8.1. These Terms are governed by and construed in accordance with the federal laws of the United Arab Emirates and the local laws of the relevant Emirate.
8.2. Any dispute or claim arising out of or in connection with these Terms that cannot be resolved through informal Platform mediation shall be submitted to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
9. MODIFICATIONS
9.1. The Platform reserves the right to update these Terms at any time. Continued use of the Platform following updates constitutes binding acceptance of the revised Terms.
